ORDER

Having issued a notice on 21.07.2025 fixing the date of hearing on 03.09.2025, the first respondent had proceeded to pass orders on 02.09.2025 (impugned herein), which would clearly indicate that no opportunity of hearing was given to the petitioner herein. Hence, the order suffers not only from the vice of violation of principles of natural justice, but also is a colourable exercise of power. In that regard, this Court has no hesitation in holding that the impugned order is liable to be interfered with.

2. Accordingly, the impugned order is set aside and the first respondent is directed to conduct a fresh enquiry after affording an opportunity of hearing to the petitioner and the fourth respondent and pass orders on merits and in accordance with law within a period of twelve weeks’ from the date of receipt of a copy of this order.

WP(MD) No. 13574 of 2026

3. With the above direction, this Writ Petition stands allowed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 12-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ABR To
