ORDER

Challenging the refusal check slip of the first respondent dated 10.06.2026, the petitioner is before this Court.

2. The refusal check slip had been issued primarily on the ground that a protest petition has been filed by the third respondent.

3. The learned counsel for the third respondent would submit that a sale agreement had been entered into between the petitioner and the third respondent and the third respondent had paid a sum of Rs.21,00,000/- as part sale consideration of the property.

4. A Division Bench of this Court in a batch of writ petitions in W.P.(MD) Nos.7415 of 2026 etc., by order dated 26.03.2026, had struck

WP(MD) No. 16953 of 2026 down the provisions of Section 34-C of the Registration Act, 1908, inserted by the Registration (Tamil Nadu Amendment) Act, 2026. In such view of the matter, this Court is of the view that the present refusal check slip would have to be interfered with.

5. Accordingly, this Writ Petition stands allowed and the impugned refusal check slip No.RFL/Tallakulam/49/2026, dated 10.06.2026 is set aside. However, the third respondent is at liberty to approach the appropriate civil Court for remedying his grievances. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 12-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ABR To
