PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court for issuance of a Writ of Certiorarified Mandamus to call for the records related to order passed by the third respondent in Na.Ka.A2/O.P.110/2026 dated 16.07.2026 and quash the same as illegal, contrary and violation of natural justice and subsequently direct the first respondent to cancel the forged Sale Deed in Document No.1003/2000 on the file of the Sub Registrar, Karungal Registration Office, Kanniyakumari executed in favor of the sixth respondent.

ORDER
Asserting that the petitioner is the legal heir of one Soosai and that the petitioner consequently inherited the lands in Survey No.237/12 in Mullanginavillai, Killyur Taluk, Kanyakumari District, the petitioner challenged the order dated 16.07.2026 and also requested for a direction to the first respondent to cancel Sale Deed bearing Document No.1003 of 2000 on the file of the Sub-Registrar Office, Karungal, Kanyakumari.
2. Learned Government Advocate for the first to fourth respondents submits that the petitioner is not a party to the impugned order and that title was not decided under the said order.
3. On perusal of the impugned order dated 16.07.2026, it is clear that the petitioner is not a party thereto. The said order also does not decide the title relating to the land in Survey No.237/12. If the petitioner intends to challenge the registered instrument, the appropriate course of action is for the petitioner to approach the jurisdictional civil court.
