O R D E R

The petitioner, who was engaged in MD Spl 23 Kodangipatti Primary Agricultural Co-operative Societies, Theni in the year 1997 has been allowed to continue in service and on 21.09.2026, he was issued with a show cause notice stating that his initial appointment itself was irregular. Challenging the said show cause notice, the petitioner has filed this writ petition.

2. The learned counsel appearing for the petitioner submits that the petitioner’s service was already regularised and his scale of pay was settled as applicable to the permanent employees from the year 2013 onwards. It is further submitted that the issue with regard to his appointment was already considered even in the year 2012 and at the instance of the Registrar of Cooperative Societies, he was reinstated into service and his service was also regularised. Therefore, according to the learned counsel, the very same issue cannot be raised once again, by way of the present show cause notice. The learned counsel for the petitioner submits that the petitioner is a permanent employee and there is no audit objection in the audit reports. Moreover, his appointment is within the cadre strength. The learned counsel also submits that employees appointed prior to 2001 and worked for 480 days in 24 calendar months were made permanent and therefore, the same would be applicable to this petitioner as well.

3. The learned Additional Government Pleader appearing for the respondents has raised a preliminary objection by referring to the judgment of the Honourable Full Bench in K.Marappan Vs. Deputy Registrar of Co-operative Societies that the matter pertains to an employment in a Co-operative Society and therefore, it cannot be entertained by way of this writ petition. He further submits that this Court has taken a similar view in W.P.(MD) No.19298 of 2025, dated 07.10.2026. According to the learned Additional Government Pleader, the petitioner’s appointment in the second respondent Society was not made through the prescribed recruitment process or Employment Exchange channel. In fact, he was initially engaged at the age of 18, only on consolidated wages. His initial appointment and the later grant of time-scale of pay are also irregular. Therefore, he was rightly dismissed on 11.06.2002. He further submits that the petitioner was again re-appointed on 26.06.2023, by a Resolution, dated 26.06.2013, which is also an illegal. The present show cause notice, dated 21.09.2026 has been issued calling upon the petitioner to explain as to why his appointment should not be terminated as illegal and irregular. The petitioner has to offer his explanation to the show cause notice.

4. This Court considered the rival submissions and also perused the materials placed on record.

5. The order impugned in this writ petition is only a show cause notice and pertains to an employment in a Co-operative Society. Therefore, this Court is not inclined to entertain this writ petition, in view of the guidelines issued by the Honourable Full Bench in K.Marappan vs. The Deputy Registrar of Co-Operative Societies, reported in 2006 (4) CTC 689. It is also reported that this Court, in earlier occasion has taken a similar view in W.P.(MD) No.19298 of 2025, dated 07.10.2026.

6. In view of the same, this writ petition is closed with liberty to the petitioner to submit his explanation to the show cause notice, dated 21.09.2026 issued by the second respondent Society. No costs. Consequently, connected Miscellaneous Petition is also closed. 12-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No VRN
