ORDER
The petitioner asserts that she belongs to the Devendrakula Vellala community and that her husband, who is from the State of Kerala, belongs to the Thandan community, which falls under the sub-caste Thiyya community. The application for issuance of Inter Caste Marriage Certificate was rejected under impugned order dated 03.07.2026.
2. Relying on G.O. (Ms). No.55, Backward Classes, Most Backward Classes and Minorities Welfare (BCC) Department, dated 15.07.2020, learned counsel for the petitioner submits that Thiyya community is included in the list of backward classes. Since the impugned order did not take this into account, he submits that reconsideration is warranted.
3. Mr. R. Parthiban, learned Special Government Pleader, accepts notice for the respondents. He submits that the matter may be remanded for reconsideration in the light of the above-mentioned Government
Order.

4. On perusal of the impugned order, it is noticeable that second respondent rejected the request for an Inter Caste Marriage Certificate after recording that it is unclear as to whether the Thiyya community falls within the list of Scheduled Castes or within the list of Other Backward Classes in Tamil Nadu. On examining G.O. (Ms). No.55, it appears prima facie that the Thiyya community falls within the list of Backward Classes. Hence, reconsideration is warranted. Towards that end, the impugned order is set aside and the matter is remanded to the second respondent for reconsideration. After providing a reasonable opportunity to the petitioner and taking note of G.O. (Ms.) No.55, a fresh order shall be issued within one (1) month from the date of receipt of a copy of this order.
5. This Writ Petition is disposed of on these terms. There shall be no order as to costs. 12-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No apd __________
