ORDER

Heard learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the 1st Respondent.

WP(MD) No. 29245 of 2026

2. Considering the limited sought for in the Writ Petition, notice to the 2nd respondent is dispensed with.

3. The petitioner seeks a Writ of Mandamus to restrain the 1st respondent from registering any document that may be presented by the 2nd respondent in respect of the property in question.

4. It is the claim of the petitioner that the property in question is ancestral property belonging to the petitioner and the 2nd respondent. However, the revenue records pertaining to the said property have been mutated solely in the name of the 2nd respondent and the petitioner apprehends that the property may be dealt with by the 2nd respondent. The petitioner claims to have taken necessary steps before the revenue authorities for effecting the requisite corrections in the revenue records. In the meantime, the petitioner has also submitted a representation to the 1st respondent requesting that no document in respect of the ancestral property be registered.

5. The registering authorities are not empowered to adjudicate disputes relating to title between the parties, except to the extent permitted under the provisions of the Registration Act. It is always open to the petitioner to approach the competent Civil Court for appropriate relief in respect of his grievance against the 2nd

WP(MD) No. 29245 of 2026 respondent. However, it is pertinent to note that the petitioner has already approached the revenue authorities seeking correction of the revenue records. If the petitioner is able to establish his claim before the revenue authorities, he may take appropriate steps in accordance with law.

6. With the above observations and directions, this Writ Petition is disposed of. There shall be no order as to costs. 12-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No Nsr To:
