ORDER

Heard learned counsel appearing on either side.

WP(MD) No. 29340 of 2026

2. By consent of both parties, this Writ Petition is taken up for final disposal.

3. This Writ Petition is filed for issuance of Writ of CERTIORARIFIED MANDAMUS, challenging the impugned order passed by the 2nd respondent in RFL/ Gangaikondan/179/2026 dated 24.09.2026 and consequently direct the 2nd respondent to register the lease deed executed by the Petitioner dated 24.09.2026.

4. Indicating twin reasons, namely, that a petition filed by the petitioner's mother against the petitioner under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, was pending and that a partition suit in O.S.No.341 of 2025 on the file of the Principal District Court, Tirunelveli, was also pending, the lease deed sought to be registered by the petitioner, as a lessor, was returned along with a refusal slip.

5. The learned Counsel for the petitioner placed on record the plaint in O.S. No. 341 of 2025, which had been referred to as one of the reasons for refusal. A perusal of the schedule to the plaint would indicate that the survey number, namely Survey No. 352/1, which is the demised property, does not form part of the schedule of properties. Similarly, with regard to the pendency of the proceedings before the

WP(MD) No. 29340 of 2026 Revenue Divisional Officer, Tirunelveli, in respect of the petition filed by the petitioner's mother, the proceedings dated 09.07.2026, indicates the disposal of the same, along with the death certificate of the petitioner's mother. In view of the above, the reasons stated by the 2nd respondent for issuing the refusal check slip are found to be non-existent. Hence, the impugned refusal check slip is liable to be interfered with.

6. Accordingly, the Writ Petition stands allowed, and the impugned refusal slip dated 24.09.2026 stands set aside. The petitioner is directed to re-present the said document before the 2nd respondent and, upon receipt of such re-presentation, the document shall be registered, if it is otherwise in order. There shall be no order as to costs. 12-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No Nsr To:
