The Criminal Appeal challenges the dismissal of the bail application filed by the appellant/A2 in Crl.M.P.No.343 of 2026 in Spl.S.C.No.38 of 2026 dated 08.09.2026 on the file of the learned Sessions Judge (FAC), Special Court for trial of Cases under SC/ST (Prevention of Atrocities) Act, Salem.

3. The learned counsel for the appellant/A2 would submit that the appellant is in custody for more than 126 days; that the investigation has been completed and the final report has been filed and taken on file in Spl.S.C.No.38 of 2026; and that the further incarceration of the appellant is not required for the purpose of trial.
4. Mr.R.Raghuraj, the learned Legal Aid Counsel for the third and fourth respondents, would submit that the appellant who is arrayed as A2 has three previous cases, and since he is a habitual offender, no indulgence should be shown, especially in view of the overt act attributed to him.

(vii) the appellant shall not tamper with evidence or witnesses either during investigation or trial;
(viii) on breach of any of the aforesaid conditions, the learned Sessions Judge/Trial Court is entitled to take appropriate action against the appellant in accordance with law as if the conditions have been imposed and the appellants released on bail by the learned Sessions Judge/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
(ix) if the accused thereafter absconds, a fresh FIR can be registered under Section 229A IPC.
