ORDER

The present petition has been filed by Accused No.10 in Crime No. 18 of 2023, on the file of the first respondent police, seeking to quash the FIR, in which the petitioner and others are alleged to have committed offences punishable under Sections 143, 283, and 291 of the Indian Penal Code (IPC).

2. A perusal of the FIR reveals that the President of the Jallikattu Committee and 11 others are alleged to have unlawfully assembled at about 10:30 a.m. on 05.01.2023 and raised slogans against the District Administration over its decision to permit the conduct of Jallikattu by certain individuals, instead of entrusting its conduct to the general public of Avaniyapuram.

3. According to the learned counsel appearing for the petitioner, the incident was a protest against the decision taken by the District Administration, during which no inconvenience was caused to the general public and no public property was damaged.

CRL OP(MD) No. 14611 of 2026

4. Heard the submissions made on either side and perused the materials available on record.

5. As could be seen from the FIR, the petitioner, who is a member of the Jallikattu Committee, protested against the decision taken by the District Administration and raised slogans. Such an act cannot be construed as a criminal offence. The other accused persons also stand on the same footing.

6. In such circumstances, the continuation of the criminal proceedings against the accused persons would amount to an abuse of the process of law. Accordingly, the FIR in Crime No. 18 of 2023, on the file of the first respondent police, is hereby quashed not only insofar as the petitioner is concerned but also for other accused persons.

7. Accordingly, this Criminal Original Petition is allowed. Consequently, connected miscellaneous petition is closed. 09-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No gvn
