COMMON ORDER
These batch of civil revision petitions are filed by the Airports Authority of India, challenging the orders passed in execution petitions, attaching the primary bank account of the revision petitioner, in execution of the awards passed in favour of the respondents, in land acquisition proceedings.
2. I have heard Mr.Ramaswamy Meyappan, learned counsel for the revision petitioner in all the revision petitions, Mr.Suhrit Parthasarathy for Mr.K.S.Navin Balaji, learned counsel for the respondents/land owners, Mr.Bijesh Thomas for Mr.K.F.Manavalan, learned counsel for the other respondents/land owners and Mr.T.Gowtham, learned Additional Advocate General assisted by Mr.P.Sunil, learned Government Advocate for the official respondents in all the revision petitions.
3. The learned counsel for the revision petitioner would contend that the petitioner being a public sector entity, the Executing Court, by ordering attachment of the primary bank account, has caused serious prejudice and hardships to the Government and the attachment order would invite unnecessary complications in discharging public duty, including disbursement of salaries to the employees of the petitioner and meeting expenses relating to public cause. He would further state that admittedly, an appeal is pending against the land acquisition compensation amount awarded to the respondents/land owners and therefore, the Executing Court erred in permitting coercive measures to be initiated against the revision petitioner.
4. It is also the submission of the learned counsel for the petitioner that the duty to pay compensation to land losers is only on the acquiring authority who is the dispensing authority and not the beneficiary, namely the revision petitioner. He would therefore state that execution proceedings can be laid only against the State of Tamil Nadu, which alone is the appropriate party, against whom in fact the land acquisition proceedings were initiated and the execution proceedings therefore cannot be laid against the beneficiary of the land acquisition proceedings, namely the revision petitioner. He would further state that the State Government had already preferred appeals, challenging the compensation awarded by the Reference Court and the matter has not attained finality and therefore, the Executing Court clearly erred in taking the extreme step of ordering attachment of the primary bank account of the revision petitioner, which would practically cripple the very functioning of the revision petitioner.
5. Per contra, Mr.Suhrit Parthasarathy, Mr.K.F.Manavalan and Mr.Bijesh Thomas, learned counsel for the respondents/land owners would contend that it is a very unfortunate case where even without initiating land acquisition proceedings in a manner known to law, possession was taken forcibly from the land owners way back in 1960s and only after the land owners approached this Court, the proceedings under the Land Acquisition Act were even initiated. They would further state that for more than six decades, they have been waiting for fair and just compensation to be paid to them and unfortunately, even the original land owners have passed away and the successive generation of legal heirs are now fighting for getting their legitimate and due share of compensation. They would further state that it is only the petitioner, who deposited the compensation amount, in compliance with the orders of Court earlier and therefore, today, the petitioner cannot attempt to take a stand, contending that they are only beneficiaries of the acquisition proceedings and the entire liability should be saddled on the State Government, the acquiring authority.
6. The learned counsel for the respondents would also bring to my notice several orders that have been passed by this Court in connected proceedings to drive home their submissions that the petitioner cannot, that too, at this belated juncture, attempt to shift the liability on the State and avoid settlement of the compensation amounts payable to the land owners, whose lands have been acquired and possession has also been taken from them and the lands have also been put to use for the benefit of the revision petitioner.
7. I have carefully considered the submissions advanced by the learned counsel on either side.
8. Even forgetting the allegations of the respondents/land owners that possession was taken from them even in late 1960s and much later, the land acquisition proceedings were initiated, even as per the admitted records, the award itself came to be passed as early as in 2002. The Land Acquisition Officer awarded a compensation of Rs.6.88/- per sq.ft. On reference to the Civil Court, the compensation was enhanced to Rs.100/- per sq.ft. The LAOP proceedings concluded in the year 2014. The said land acquisition awards were challenged belatedly in 2017 and 2018 and conditional orders requiring deposit of 50%, for even entertaining the condone delay applications was imposed on the petitioner and admittedly, the said order was modified by subsequent orders and in all, a sum of Rs.10 crores has been deposited only by the revision petitioner.
9. Though the learned counsel for the petitioner has reiterated that a huge sum of Rs.10 crores has already been deposited by the petitioner, considering the actual amounts due and payable in terms of the award, the said amount of Rs.10 crores, in fact, pales into insignificance and therefore, I am unable to countenance the line of arguments advanced by the learned counsel for the petitioner to the factum of the petitioner having deposited Rs.10 crores.
10. The land losers, who have been deprived of their property way back in the year 1960s, are yet to see the colour of the coin. As already indicated, the land acquisition proceedings before the Reference Court also ended in 2014 and despite the same, till date, the petitioner has not been able to obtain any interim stay or protection from this Court, in appeal proceedings.
11. Further, as rightly pointed out by the learned counsel for the respondents, even the sum of Rs.10 crores that has been deposited is only by the petitioner and not by the acquiring authority, namely the State Government. Therefore, it does not lie in the mouth of the petitioner to contend that the it is not their liability to meet compensation amount and the State Government alone, being the acquiring authority, has to compensate the claimants/land owners. Though it is also contended by the learned counsel for the petitioner that the policy of the State Government has changed under the new policy, the State Government is obligated to acquire and hand over lands free of cost to the Airports Authority of India, admittedly, the present acquisition proceedings are not pursuant to the new policy and therefore, citing subsequent change of policy, the petitioner cannot try to wriggle out and contend that they are not liable to meet the compensation amount payable to the land losers.
12. Coming to the impugned order, the Executing Court, rightly finding that there is no stay of the compensation awards in favour of the claimants, rightly rejected the contention of the revision petitioner that the compensation has to be met only by the State Government and not by the revision petitioner and proceeded to order attachment of the bank account of the petitioner. I do not see any perversity or infirmity in the said order, warranting interference in revision petition. Merely because the petitioner's primary bank account is sought to be attached, it cannot be a ground for interference, when admittedly huge amounts payable by way of compensation to land losers, have not been paid for decades together. In the light of the above, I do not see any merit in the revision petitions, warranting interference with the well merited order of the Executing Court, ordering attachment of the primary bank account of the petitioner.
13. In fine, these Civil Revision Petitions are dismissed. The petitioner is directed to settle the claim of the respondents in full settlement, within a period of eight weeks from today. It is needless to state that in the event of the petitioner settling the amounts due and payable to the respondents/land owners, as stipulated herein above, the order of attachment shall stand raised. However, in the event of the compensation amount not being fully settled, then the respondents are at liberty to proceed, in pursuance of the order of attachment under challenge in these revision petitions and take such further steps in accordance with law, to satisfy their respective compensation claims. No costs. Connected Civil Miscellaneous Petitions are closed. 09-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ATA
