ORDER
Learned counsel seeks permission to withdraw the Original Petition with liberty to move an application before the competent Civil Court having jurisdiction.
OP No. 180 of 2025
2. Learned counsel for the respondent also has no serious objection. Hence the original petition is dismissed as withdrawn with liberty to file a fresh application before the competent court of jurisdiction.
3. Learned counsel for the respondent state that in compliance with the directions issued by this Court and also in view of the petitioner proposing to withdraw the Original Petition itself, the respondent was called upon to withdraw the pending Original Side Appeals which has been complied with and the respondent has already withdrawn the Original Side Appeal. The same is recorded.
4. Learned counsel for the petitioner brings to my notice that the petitioner has been enjoying interim visitation rights. However, since the Original Petition is being dismissed as withdrawn, the petitioner is at liberty to take out fresh application for visitation rights in the fresh Original Petition, proposed to be filed.
