Order
(Order of the Court was made by N.Sathish Kumar J.) This petition has been filed to grant leave to the appellant to prefer the above appeal against the order passed in Comp.A.No.40 of 2025 in CP.No.57 of 1998 dated 19.08.2026.
2. On hearing both sides, when this Court posed the question as to how this petition is maintainable, since the petitioner had already filed an appeal in OSA.No.150 of 2026 challenging the very sale itself, the learned counsel for the appellant submitted that appellant may be permitted to canvass their case in the pending appeal.

3. In such view of the matter, when the very sale itself is challenged in appeal in OSA.No.150 of 2026, the petitioner/appellant can very canvass their case in the pending appeal. Accordingly, We do not find any merits in this case and this miscellaneous petition stands dismissed. Consequently, the un- numbered OSA.SR.No.151082 of 2026 stands rejected. No costs. (N.S.K.,J.)
