ORDER

This Writ Petition has been filed for the issuance of a Writ of Mandamus directing the respondents to consider the claim of the petitioners for appointment of the 2nd petitioner on compassionate grounds in any suitable post commensurate with his educational qualification, consequent on the death of his father, late.Thiru.S.Magudeswaran, while serving as Head Constable (HC No.269) in Erode South P.S., on 19.05.2008.

2. The learned counsel for the petitioner submitted that the 1st petitioner’s husband was serving in the respondent department and died on 19.05.2008. Thereafter the petitioner had submitted an application for compassionate appointment dated 24.02.2009. Though the 3rd respondent had sought certain documents from the petitioner and forwarded them to the 2nd respondent, so far the petitioners have not received any reply.

3. At this juncture, the learned Special Government Pleader contended that initially, the 1st petitioner had submitted an application for compassionate appointment during 2009 and that she was placed in the seniority waiting list at No.1723. When the said application was in process, she sent a representation to the 2nd respondent dated 05.05.2017 requesting the 3rd respondent to appoint the 2nd petitioner on compassionate grounds due to her illness.

WP No. 11688 of 2024

4. The learned Special Government Pleader further submitted that while considering the matter at that time, the 2nd petitioner had attained 18 years of age and passed 10th standard. When the respondents were processing the application for appointing the 1st petitioner on compassionate grounds, her initial request was later diverted through a second representation to appoint her son and such application is of the year 2017 and the same would be taken as 2017 seniority. Hence it is the submission of the learned Special Government Pleader that as and when the seniority of the 2nd petitioner reaches, the respondents would consider the same in accordance with law.

5. Recording the said submission of the learned Special Government Pleader, this Writ Petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs. 09-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SHL
