Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue writ of mandamus, praying to direct the 2nd and 3rd respondents herein to
revise and refix my DCRG and pension by counting the services rendered from 24.08.1979 to 31.05.1995 and the period from 1.06.1995 to 31.5.2017 (totally 37 years, 9 months and 7 days of service) as qualifying service and confer all the retirement benefits by considering the petitioner representations dated 15.10.2022 in the light of the order passed in W.A. (MD) No. 370 of 2019 dated 22.10.2019 by the Madurai Bench of Madras High court.

ORDER
The present writ petition has been filed seeking issuance of writ of mandamus to direct the respondents 2 and 3 to consider the joint representation dated 15.10.2022 submitted by the petitioner to the respondents seeking revision of pension so as to include his 50% of the past service before the date of his regularisation.
2. In this regard, the learned counsel for the petitioner relied upon the judgment of Full Bench of this Court in batch of writ appeal in W.A.No.158 of 2016 reported in 2019 (6) CTC 705.

At this juncture, the learned Special Government Pleader refers about another Full Bench judgment of this Court in the case of A.Elangovan Vs State of Tamil Nadu and Others in W.P.No.17628 of 2018 dated 06.04.2026 and contend that if there was any part-time service, that cannot be counted for pension service. However, the learned Special Government Pleader, in all fairness, would submit that they would consider the petitioner's representation on its own merits and in accordance with the law.

In such view of the above submissions, without going into the merits of the matter, this Court directs the first respondent to consider the petitioner's representation dated 15.10.2022 according to its own merits and in accordance with law and pass appropriate orders within a period of eight(8) weeks from the date of receipt of copy of this order.
