ORDER

The present writ petition has been filed only for a limited relief to consider the petitioner's representation dated 24.01.2024.

2. In this regard, Mr.Arvind Raj, learned counsel appearing on behalf of learned Special Government Pleader (Puducherry) for the respondents 1 and 2, submitted that they would consider the petitioner's representation dated 24.01.2024 within a reasonable time fixed by this Court.

3. At this juncture, the learned counsel for the 3rd respondent seeks short accommodation to get instructions.

4. However, while perusing the documents submitted by the petitioner, the petitioner has already been permitted to retire voluntarily vide 3rd respondent’s letter dated 29.05.2023. Though the matter is pending since 2024, the conduct of non-filing of counter by the 3rd respondent for almost two years would only lead to presume that they may have no serious objection. However, the learned counsel for the 3rd respondent would submit that their grievance is with respect to non-furnishing of certain documents by the petitioner, as evidenced from 3rd respondent's letter dated 05.04.2024 in Ref.No.680/FGABHS/2024.

5. Considering the efflux of time and the nature of issue, this Court would like to direct the 3rd respondent to send a letter informing about documents which they require within a period of four weeks from the date of receipt of

WP No. 27029 of 2024

copy of this order. On receipt of such letter from the 3rd respondent, the petitioner is directed to submit whatever documents the 3rd respondent require to prepare a proposal within a further period of one week. On receipt of such necessary documents, the 3rd respondent is directed to send a proposal to the respondents 1 and 2 within a further period of two weeks. On receipt of such proposal, the respondents 1 and 2 are directed to consider the same on its own merits and in accordance with law and pass appropriate orders within a further period of four weeks.

6. With the above direction, the writ petition stands disposed of. No costs. 09-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No NR TO
