ORDER

The present writ petition has been filed challenging the impugned rejection order of the petitioner on the ground of the medical examination report dated 04.08.2023.

2. The learned counsel for the petitioner would submit that since the petitioner was suffering from female pattern androgenetic alopecia, she was considered to be unfit. The learned counsel would submit that alopecia is nothing but hair fall issue, and moreover, it may not have any impact upon the performance of an individual. The learned counsel would submit that the petitioner had been selected in all the written and endurance tests. Having passed in all the tests, the rejection on the ground of some dermatological issue, would affect the right to life of the petitioner. Hence, prayed to interfere with the same. The learned counsel has also relied upon a judgment of the High Court of Calcutta passed by the learned Single Judge in W.P.A.No.28703 of 2025, wherein the High Court has held that alopecia is not a ground to consider for rejection. Hence, it is prayed to allow this writ petition.

3. The said contention was objected to by the learned Senior Panel Counsel appearing on behalf of the respondents. It is the contention of the learned Senior Panel Counsel that this disorder of alopecia would manifest in a

person on account of an endocrinological, metabolic or autoimmune disorder; therefore, it cannot be construed as a mere dermatological issue. It relates to an endocrinological, metabolic or autoimmune disorder.

4. The learned Senior Panel Counsel invited the attention of this Court to the general grounds for rejection of the guidelines for Recruitment Medical Examinations in the Central Armed Police Forces and Assam Rifles (Revised Guidelines as of May 2015). In which Clause 6 refers to an endocrinological disorder as one of the ground for rejection. Therefore, it is the specific submission of the learned Senior Panel Counsel that since the petitioner's disorder of alopecia may also be related to an endocrinological issue, the order of the Review Medical Examination Board declaring her unfit cannot be interfered with. It is also his contention that the expert committee having arrived at such a conclusion, this Court, while exercising the power of judicial review, cannot second guess the finding and hence prays to dismiss this application.

5. I have given my anxious consideration to the submissions made on either side.

6. It is not in dispute that the petitioner had a disorder of female pattern androgenetic alopecia. Though the learned counsel for the petitioner would contend that this is a mere dermatological issue which only causes hair fall, the

contention of the learned Senior Panel Counsel for the respondents needs reference.

7. According to the report dated 04.08.2023, this female pattern androgenetic alopecia is caused with reference to an endocrinological, metabolic or autoimmune disorder. Therefore, when a disorder is related to certain other factors like an endocrinological issue and such an endocrinological issue is one of the factors for rejection, this Court, while exercising the power of judicial review, cannot sit in appeal over the expert opinion. Though it is a well- settled principle of law that an expert opinion is only to be respected and not to be worshipped, here there is no contra material to overlook the opinion given in the impugned order.

8. In the light of the above factual position, this Court absolutely finds no grounds to interfere with the impugned order. Accordingly, this writ petition stands dismissed. No costs. 09-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No NSL
