ORDER

The learned counsel for the petitioner submitted that the petitioner was appointed as Office Assistant on compassionate ground in third respondent's school. The learned counsel further submitted that for approval of his appointment, the 3rd respondent sent a proposal to the 1st respondent on 27.05.2022. It is the contention of the learned counsel for the petitioner that since 27.05.2022 such proposal has not been considered by the first respondent.

2. At this juncture, the learned Additional Government Pleader for the respondents 1 and 2 would contend that as per the staff fixation order issued for the year 2018-2019, one Office Assistant post was found surplus and the same were surrendered to the common pool of the Director. However, it is the contention of the learned counsel for the petitioner that since the third respondent being a minority school, such surrender cannot be done. At this juncture, the learned Additional Government Pleader submitted that the proposal of the third respondent dated 27.05.2022 would be considered on its own merits and in accordance with law.

3. In such view of the above submissions, this Court would like to direct the first respondent to consider the proposal sent by the 3rd respondent on 27.05.2022 on its own merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.

4. With the above direction, the writ petition stands disposed of. Consequently, the connected miscellaneous petition is closed. No costs. 09-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No NR To
