ORDER

The writ petition has been seeking a mandamus to the respondents to consider the petitioner's representation dated 13.07.2026 and to provide him the details sought therein in connection with the appeal filed on 05.10.2021 before the respondent.

2. The case of the petitioner is that his father Lingappa Gounder had died on 14.08.1993, leaving behind his wife Chellammal, his daughter Rathimalathi and his sons Palanisamy and the petitioner herein. After the death of his father, the petitioner had obtained a legal heirship certificate from the Tahsildar, Sathyamangalam, on 23.05.2018. While so, on 28.07.2020, one Periya Palaniammal, claiming herself to be the daughter of his father, born through his mother late.Palaniammal, alleging to be the first wife of Lingappa Gounder, had given a representation to the Tahsildar, Sathyamangalam, to cancel the legal heirship granted to the petitioner's family. Pursuant to which, based on the recommendations of the Revenue Divisional Officer, Gobichettipalayam, the Tahsildar vide his proceedings in Pa.Mu.3940/2020/E2 dated 27.08.2021 had cancelled the legalheir certificate and directed the petitioner and his family members to approach the civil Court to obtain the legal heirship certificate.

3. Challenging the proceedings of the Revenue Divisional Officer, the petitioner had filed an appeal before the District Collector, Erode, the first respondent herein, on 05.10.2021, and the same is pending on the file, without reaching its conclusion. Therefore, the petitioner had submitted an application on 13.03.2026 under RTI Act, seeking the status of his appeal. However, the RTI authority in its reply dated 10.04.2026, has informed the petitioner to approach the Office of the District Collector, Erode. Thereafter, the petitioner had submitted his application on 13.07.2026 to the first respondent to provide him with the current status of the appeal and also to furnish the copies of orders and notices issued in connection with the appeal dated 05.10.2021. However, the petitioner's representation was not considered to date. Hence, the petitioner is before this Court.

4. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondent.

5. Considering the limited scope of prayer sought for in this writ petition, this Court without going into merits of the case, directs the respondent to consider the representation of the petitioner and dispose of the appeal itself within a period of one month, as the same is pending on its file for more than 5 years.
