ORDER

This Writ Petition has been filed for the following reliefs:- “Directing the respondents to issue legal heirs certificate for the first and second petitioners paternal uncle late. Thangaraj son of Konda Nayakar mentioning the first petitioners name R.Balasubramaniam and the second petitioners name R.Babu as his legal heirs in accordance with within the time stipulated by this honourable court.”

Brief Facts:-

2. The Petitioners would submit that their paternal grandfather, Late Konda Nayakar, had three sons and one daughter, namely, Late Rangasamy @ Ponnusamy, the Petitioners' father, Late Palanisamy, Late Thangaraj and Late Janaki. The Petitioners would further submit that their paternal uncle, Late Thangaraj, died as a bachelor on 15.11.2025. Since their paternal grandfather, paternal grandmother, paternal aunt, father and another paternal uncle had predeceased Late Thangaraj, the Petitioners claim entitlement to succeed to his properties as his legal heirs under the applicable provisions of Hindu succession law.

WP No. 40482 of 2026

3. The Petitioners would submit that, claiming to be the Class-II legal heirs of Late Thangaraj, they approached the 2nd Respondent for issuance of a legal heirship certificate. However, they were instructed by the officials concerned to submit an online application. Accordingly, on 27.07.2026, the Petitioners submitted an application bearing Application No.TN-720260727461, along with the relevant supporting documents. However, the application was accepted only in their capacity as applicants, and their claim as Class-II legal heirs was not duly considered.

4. The Petitioners would further submit that, upon verification, the 2nd Respondent issued a legal heirship certificate on 02.08.2026, wherein the persons mentioned as legal heirs had all predeceased Late Thangaraj. Aggrieved by the same, the Petitioners submitted a further representation dated 21.08.2026 to the Respondents, seeking issuance of a proper legal heirship certificate recognising their claim as the legal heirs of Late Thangaraj. However, no appropriate action has been taken on the said representation to date. Hence, the present Writ Petition seeking the reliefs stated supra.

5. Heard the learned counsel on either side.

6. Considering the facts and circumstances of the case and the relief sought by the Petitioners, this Court, without expressing any opinion on the
