Order

(Order of the Court was made by S.M.Subramaniam J.) The present writ of mandamus has been instituted to direct the first respondent to dispose of the statutory appeal preferred under Section 10 of the Land Encroachment Act, 1905.

2. Issuing a direction to dispose of the appeal within a timeline by the authority may cause prejudice to the interest of other persons, who have filed appeals and waiting for disposal of their respective appeal. There may be several appeals which may be pending and all those appeals are to be considered in the order of seniority and priority may be given only in exceptional cases. However, the appellate authority is expected to dispose of the appeal within a reasonable time without any undue delay. Courts issuing a direction fixing timeline is unnecessary since the disposal of other appeals will get delayed. That being the factum, the first respondent is directed to dispose of the appeal in the order of seniority as expeditiously as possible.

WP No. 41421 of 2026

3. With the above direction, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. (S.M.S.,J.) (R.R.V.,J.) 09-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No KST To
