PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned proceedings issued by the respondent Tamil nadu Joint Director of School Education (Personnel) in Na.Ka.No.78962/A4/E2/2024 dated 28.02.2025 quash the same, and further direct the respondent to transfer the petitioner to District Educational Office (Private Schools) Nagercoil, Kanyakumari District from Government Higher Secondary School, Vallankumaravillai, Kanyakumarri District.

ORDER
The petitioner, who was working as a Junior Assistant in the District Educational Office (Private Schools), Nagercoil, was transferred to Government Higher Secondary School, Vallankumaravillai, Kanyakumari District, by order dated 16.10.2023, based on certain allegations raised by the All India Private Schools Law Protection Society. The petitioner had earlier challenged the order of transfer in W.P.(MD) No.26401 of 2023, and the said Writ Petition was disposed of on 30.09.2024, with a direction to the second respondent therein to consider the petitioner's case for re-transfer to the District Educational Office, Nagercoil. However, the petitioner's request, made pursuant to the order of this Court, was rejected on the ground that there was no vacancy in the District Educational Office, Nagercoil.
2. In the meantime, the respondents had also conducted an inquiry into the allegations made by the All India Private Schools Law Protection Society and found that the complaint was not substantiated. Consequently, the complaint made by the said Society was closed as frivolous. Challenging the order rejecting his request for accommodation __________

WP(MD) No. 11606 of 2025 at Nagercoil, pursuant to the order passed by this Court in W.P.(MD) No.26401 of 2023, the petitioner has now filed the present Writ Petition.
3. The learned Additional Government Pleader appearing for the respondent submits that there is presently no vacancy in the District Educational Office, Nagercoil, and that the petitioner would be considered favourably during the ensuing counselling.
4. This Court has considered the rival submissions made on either side and perused the materials on record.
5. The petitioner was working as a Junior Assistant and was transferred based on a complaint made by a Society. The said complaint was found to be unsubstantiated and was closed. Even earlier, while dealing with the order of transfer passed against the petitioner in W.P.(MD) No.26401 of 2023, this Court had directed the respondents to consider the petitioner's case for posting at Nagercoil.
6. Considering the facts and circumstances of the petitioner’s case, this Writ Petition is allowed, with a direction to the respondent to accommodate the petitioner in the District Educational Office, Nagercoil, __________
