ORDER
(Order of the Court was made by G.R.Swaminathan J.) Heard the learned counsel on either side.
2. The petitioner challenges the impugned communication issued by the local body calling upon him to remove the encroachment in question. The stand of the writ petitioner is that S.No.109/322, Ilyangudi South is a patta land and therefore, the authority will not have any jurisdiction in the matter. This stand is endorsed by the learned Additional Government Pleader.
3. The learned counsel for third respondent wants to argue to the contrary. But then, he is not able to produce any revenue entry to show that S.No.109/322 is a pathway. In these circumstances, we have no option but to quash the impugned communication. It stands quashed. The writ petition stands allowed. No costs.
