ORDER

(Order of the Court was made by G.R.Swaminathan J.) Heard both sides.

2. The writ petitioner suffered an order under Section 6 of the Land Encroachment Act on 28.09.2026. Aggrieved by the same, the petitioner has filed an appeal before the District Collector under Section 10 of the Act.

3. The grievance of the petitioner is that the eviction order is sought to be enforced in the meanwhile. The learned counsel for the petitioner points out that if the eviction order is enforced, the appeal filed before the first respondent will become infructuous.

4. We find force in the said contention. Appeal remedy is a valuable one. Hence, we direct the respondents 2 & 3 to keep the eviction order passed under Section 6 of the Act in abeyance. It shall abide by the outcome of the appeal now pending before the first respondent.
