ORDER

The Civil Miscellaneous Petition is filed seeking to extend the time for vacating the tenanted premises by three months.

2. It is seen from the records, initially the petitioner was granted time to vacate the premises on or before 30.05.2026 by order dated 16.03.2026 in CRP.No.3302 of 2025. The said order was passed based on an affidavit of undertaking filed by the petitioner that he would hand over the premises to the

landlady within the time limit fixed by this Court. Thereafter, the petitioner made a request before this Court, seeking extension of time based on an affidavit of undertaking. This Court extended the time by three months and the petitioner was also directed to pay monthly rent at the rate of Rs.8,000/-(Rupees Eight Thousand only).

3. The time extended by this Court for the second time also expired on 04.09.2026. Now, the petitioner has come up with yet another application, seeking extension of time. In the affidavit filed in support of the petition seeking extension of time, it is stated that he is a senior citizen aged about 75 years and in spite of his best efforts, he could not identify alternative accommodation and hence, further three months extension may be given.

4. The petitioner filed an affidavit of undertaking before this Court, stating that he would vacate the premises within the time fixed by this Court. Based on that affidavit of undertaking, this Court directed him to hand over possession by 30.05.2026. Thereafter, on the request made by the petitioner, time was extended by three months. Therefore, this Court feels that the petitioner has already been given sufficient time to make alternative arrangements. He failed to capitalize the indulgence shown by this Court. Therefore, I am not inclined to accept the reason given in the affidavit for extension of time.
