ORDER
The present petition has been filed challenging the order passed in Crl.M.P. No. 278 of 2025 in M.C. No. 30 of 2017, on the file of the learned Judicial Magistrate No. I, Sivakasi, whereby a non-bailable warrant was issued against the petitioner for non-compliance with the maintenance order passed in M.C. No. 30 of 2017.
2. At the time of admission, this Court, by order dated 09.04.2026, granted an interim order directing the petitioner to deposit a sum of Rs. 3,50,000/- on or before 27.04.2026. The petitioner has deposited a sum of Rs. 4,00,000/- to the credit of M.C. No. 30 of 2017. However, according to the learned counsel appearing for the first respondent, a sum of Rs. 4,76,000/- is still outstanding towards arrears of maintenance.
3. The learned counsel appearing for the petitioner submitted that, challenging the order passed in M.C. No. 30 of 2017, the petitioner had preferred a criminal revision in Crl.R.C. No. 6 of 2025 on the file of the learned Additional District and Sessions Judge, Srivilliputhur, and that the matter is posted for arguments. Therefore, the learned counsel prayed that the petitioner
CRL OP(MD) No. 6996 of 2026 be exempted from paying the balance arrears of maintenance until the disposal of the revision petition.
4. Heard the learned counsel appearing on either side and perused the material records.
5. Considering the fact that the revision petition filed by the petitioner challenging the final order passed in M.C. No. 30 of 2017 is pending, this Court is inclined to pass the following order:
(a) The petitioner is directed to pay an additional sum of Rs. 2,00,000/- directly to the first respondent towards the maintenance of the second respondent on or before 05.11.2026.
(b) Upon such payment, the enforcement of the order passed in Crl.M.P.No.278 of 2025 in M.C.No. 30 of 2017 shall be kept in abeyance.
(c) The learned Additional District and Sessions Judge, Srivilliputhur, is directed to dispose of Crl.R.C. No. 6 of 2025 on or before 30.11.2026.
(d) The petitioner is directed to pay a sum of Rs. 6,000/- per month towards maintenance to the second respondent from December 2026 onwards
CRL OP(MD) No. 6996 of 2026 until the disposal of the revision petition, in case if the criminal revision is not disposed of before 30.11.2026.
(e) In the event of any violation of the directions issued herein, the trial Court shall be at liberty to proceed in accordance with law.
6. With the above directions, this Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petitions are closed. 08-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No PS To
