dividends on and negotiate and transfer the securities mentioned in the schedule Net Amount of Rs.11,00,000/- Succession duty of Rs.25,000/- paid on 28.11.2023.

2. Heard Mr.C.Ramesh, learned counsel for the petitioner.

3. This instant Original Petition has been filed to grant a Succession Certificate in respect of the securitises left behind Dr.K.Ramanujam and his son, K.Manivannan, who died within few months, after the demise of his father Dr.K.Ramanujam in 2008.

4. The Advocate Commissioner, Mr.S.Malayappan, was appointed to examine the petitioner at his residence, considering the age, physical and health disabilities of the petitioner. The Advocate Commissioner has filed his report, enclosing the proof affidavit of the petitioner and Exs.A1 to A13.

5. From the petition averments and the proof affidavit of the petitioner, I find that the deceased Dr.K.Ramanujam died, leaving behind three sons and four daughters, one of his sons, as afore-stated already, by name, K.Manivannan died on 22.07.2008, leaving behind respondents 5, 6 and 7 as his Class I legal heirs. The Original Petition is filed for realising the securities standing in the name of both K.Ramanujam as well as K.Manivannan. The petitioner is the son

of Dr.K.Ramanujam and brother of K.Manivannan. The respondents 1, 2 and 3 are the legal heirs of the deceased daughter of Dr.K.Ramanujam, by name Shantha Narasimhan. The 4th respondent is the another daughter of the deceased Dr.K.Ramanujam. Similarly, the 8th respondent is also another daughter of the deceased Dr.K.Ramanujam. A daughter, by name Chithra, died as a spinster on 18.01.2022 and one of the sons of Dr.K.Ramanujam by name, Rangarajan died on 04.05.2016, leaving behind the 9th respondent, as his only surviving Class I legal heir. All the respondents have been arrayed as parties to the Original Petition and have given their consent affidavits, expressing no objection for the grant of Succession Certificate in favour of the petitioner as prayed for.

6. From the evidence of the petitioner, I find that the petitioner has proved that the deceased Dr.K.Ramanujam, as well as his son, K.Manivannan have died intestate, leaving behind the petitioner and the respondents as the only persons entitled to claim an interest/share in the securities left behind by the deceased. A paper publication, as directed by this Court (General Paper Publication), has also been effected in Tamil daily “Makkal Kural” and the same has also been exhibited through the Advocate Commissioner. I am satisfied that the petitioner has made out a case for issuance of a Succession Certificate, as prayed for.
