ORDER

This Writ Petition has been filed by the petitioner seeking the issuance of a Writ of Mandamus to direct the respondents to disburse the special provident fund, encashment of leave salary and unearned leave salary and other eligible Service / retirement benefits to the petitioner.

2. The learned counsel for the petitioner submitted that the petitioner was dismissed from service on 12.03.2013. He further submitted that notwithstanding his dismissal, he is entitled to have monetary benefits such as special provident fund, encashment of leave salary, unearned leave salary and other eligible service benefits.

3. At this juncture, the learned Additional Government Pleader opposed the petitioner’s eligibility for unearned leave salary, gratuity and other benefits. However, in all fairness, he submitted that if there are any eligible monetary benefit due, the respondents would consider the same within a reasonable time.

4. In such view of the factual position and taking into consideration of the age of the petitioner, without going into merits, this Court directs the 1st respondent to settle all eligible and entitled terminal benefits according to its
