ORDER

This Writ Petition has been filed by the petitioner seeking the issuance of a Writ of Mandamus to direct the 1st and 2nd respondents to settle the Provident Fund (final settlement), Special Provident Fund, Encashment of Earned Leave and Private Affairs at the petitioner’s credit as on 30.04.2017 along with interest.

2. The learned counsel for the petitioner submitted that on the eve of petitioner’s superannuation on 30.04.2017, he was placed under suspension vide order dated 28.04.2017 in contemplation of disciplinary proceedings. It is further contended that during the pendency of the writ petition, pursuant to G.O. (Ms) No.47, Human Resources Management (FR-III) Department dated 29.08.2025, the respondent permitted the petitioner to retire from service. Consequently, the disciplinary proceedings are being proceeded with under the provisions of the Tamil Nadu Pension Rules, 1978.

3. It is the contention of the learned counsel for the petitioner that not withstanding the pendency of disciplinary proceedings, the petitioner is entitled to receive the special provident fund, encashment of earned leave and other monetary benefits excluding pension and Death-cum-Retirement Gratuity (DCRG). In this connection, the petitioner sent a representation to the 1st respondent on 13.07.2022.

4. The learned Additional Government Pleader submitted that the respondents would consider the petitioner’s representation dated 13.07.2022 in accordance with G.O.(Ms) No.47, Human Resources Management (FR-III) Department dated 29.08.2025 within a reasonable time.

5. In view of the submission made by the learned Additional Government Pleader, the 1st and 2nd respondents are directed to consider the petitioner’s representation dated 13.07.2022 according to its own merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.

6. With the above direction, the writ petition stands disposed of. Consequently, the connected miscellaneous petition is closed. No costs. 08-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SHL
