ORDER

This Writ Petition has been filed by the petitioner seeking the issuance of a Writ of Mandamus to direct the respondents to consider the petitioner’s representations dated 30.11.2011, 24.04.2017 and 02.07.2022 and grant notional promotion to him to the post of Foreman Grade-I with effect from 27.01.2000 and notional promotion to the post of Special Grade Foreman with effect from 03.02.2009 and pay all the consequential benefits to the petitioner.

2. The learned counsel for the petitioner submitted that the petitioner had submitted a representation dated 30.11.2011 followed by a final reminder on 02.07.2022. It is the specific submission of the petitioner that similarly placed persons were granted notional promotion by virtue of the order passed by this Court in W.P.No.549 of 2015 dated 08.06.2022.

3. At this juncture, the learned standing counsel for the respondent submitted that they would consider the petitioner’s representation within reasonable time.

4. Since the very prayer sought by the petitioner is only for consideration of his representation. This Court, without going into the merits of the case, directs the respondents to consider the petitioner’s representation dated 30.11.2011 along with subsequent reminders including the last one dated 02.07.2022 according to its own merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that if the petitioner is a similarly placed person as that of the petitioners in W.P.No.549 of 2015 dated 08.06.2022, this Court directs the respondents to take into consideration of the judgment of this Court in W.P.No.549 of 2025, subject to its applicability to the facts of the present case.

5. With the above direction, the writ petition stands disposed of. No costs. 08-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SHL
