ORDER
(Order of the Court was made by S.M.Subramaniam J.) The relief sought for in the present writ petition is to direct the first respondent to dispose of the revision petition dated 10.08.2026 filed under Section 10A and stay application under Section 10 B of the Tami Nadu Land Encroachment Act, 1905.
2. Routine directions to dispose of the Revision petition may not be granted by the High Court in view of the fact that the authorities will be dealing with many number of such revision petitions filed by aggrieved persons. All such revision petitions are to be disposed of in the order of seniority and wherever a preference or priority is required that has to be determined by the competent authorities. In the event of issuing direction to dispose of any particular revision or appeal, the same would cause prejudice to the interest of the other appellants/revision petitioners to get disposal of their petitions pending before the competent authorities. Consistency, uniformity and transparency in dealing with the appeals are highly just and necessary. The authorities are bound to dispose of the revisions or appeals, as the case may be, within a reasonable period of time and by following the procedures as contemplated under the relevant provisions of the Statutes and Rules in force.
3. In the present case, the revision was filed only on 10.08.2026. However, the Tahsildar filed a counter stating that the subject property is a public property and the petitioner is an encroacher. May that as it be, all these issues are to be adjudicated in the revision petition and a final order is to be passed.
4. In view of the above position, the first respondent is directed to dispose of the revision petition filed by the writ petitioner as expeditiously as possible. Accordingly, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. (S.M.S.,J.)
