PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 to 3 to consider the petitioner's representation dated 28.08.2026, inspect the petitioner's premises, draw representative samples of the products proposed to be used by the petitioner, in accordance with the procedure prescribed under law, and forward the same for appropriate scientific and laboratory examination for the purpose of determining the presence or absence of tobacco, nicotine, tobacco- derived substances, or any other prohibited substances, within such time frame as may be fixed by this Court.

ORDER
The writ petition is filed seeking the following relief : " To direct the respondents 1 to 3 to consider the petitioner's representation dated 28.08.2026, inspect the petitioner's premises, draw representative samples of the products proposed to be used by the petitioner, in accordance with the procedure prescribed under law, and forward the same for appropriate scientific and laboratory examination for the purpose of determining the presence or absence of tobacco, nicotine, tobacco-derived substances, or any other prohibited substances, within such time frame as may be fixed by this Court."

2. The petitioner is running an establishment under the name and style of M/s.RVL Enterprises, which deals in the food business. The petitioner would submit that the said enterprises supplies certain herbal molasses and flavouring products intended for use in a hookah apparatus, which are free from tobacco and nicotine. The petitioner seeks scientific verification of the actual composition of the said products by the competent authorities before using them. Therefore, the petitioner had submitted a representation dated 28.08.2026 to the respondents 1 to 3 requesting to inspect the premises, drawal of samples and to forward the same for laboratory examination to determine that the products supplied by him are free from nicotine, tobacco derived substance or other prohibited substance. Since there is no response from the respondents to his representation, the petitioner is before this Court seeking the aforesaid relief.
3. Heard the learned counsel on either side and also perused the materials placed on record.
4. Considering the limited scope of prayer sought for in this writ petition, this Court without going into the merits of the case, directs the respondents 1 to 3 to consider the representation of the petitioner dated 28.08.2026, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
