ORDER

The writ petition has been filed seeking a direction to the first respondent to consider the petitioner's representation dated 22.08.2026, and to cancel the sale deed in Document No.14367/2024 dated 09.09.2024, standing in favour of fifth respondent, and to take appropriate action in accordance with law.

2. The case of the petitioner is that he is the lawful owner of the property situated in Survey No.219 Part, Block No.38, T.S.No.320, Plot No.907 in Thiruvanmiyur Village, measuring an extent of 82.66 sq.mtrs. The petitioner would contend that the subject property was sold by Tamil Nadu Housing Board in favour of the fifth respondent under Document No.5404/2019 dated 13.05.2019. Thereafter, the fifth respondent had executed a General Power of

WP No. 40420 of 2026

Attorney in favour of one S.Vijayalakshmi, who had sold the property to the petitioner under the registered sale deed Document No.1638/2024 dated 13.02.2024. Subsequent to the purchase, the petitioner has been in possession and enjoyment of the property. Be that as it may, Tamil Nadu Housing Board had executed another sale deed in favour of the 5th respondent in respect of the very same property, which was registered as Document No.14367/2024 dated 09.09.2024. Therefore, the petitioner had submitted a representation dated 22.02.2026 before the first respondent seeking cancellation of the subsequent sale of the subject property, dated 09.09.2024. Since no action was taken by the respondents, the petitioner is before this Court.

3. Heard the learned counsels on either side and also perused the materials placed on record.

4. A perusal of the records would indicate that the subject property which belonged to the respondent-Board had been sold to the fifth respondent under a registered sale deed dated 13.05.2019. The fifth respondent had thereafter executed a Power of Attorney in favour of one S.Vijayalakshmi to sell his properties through a registered Power Deed. Pursuant to which, the Power of Attorney Holder namely S.Vijayalakshmi had sold the property to the petitioner herein under the registered sale deed dated 13.02.2024. Thereafter, the respondent-Board had sold the very same property, which stands in the name of

WP No. 40420 of 2026

the petitioner, to the fifth respondent once again on 09.09.2024.

5. It is not known as to how the respondent-Board had sold the subject property twice to the very same purchaser viz., the fifth respondent, and had executed the sale deed, more particularly, when the said purchaser had alienated the property to the petitioner through his Power Agent. On coming to know about this, the petitioner had requested the respondent-Bank, the first respondent herein, through his representation dated 22.08.2026, to cancel the sale deed dated 09.09.2024 executed in favour of the fifth respondent. However, the same has not be considered to date by the respondents.

6. In the light of the above discussion, a mandamus is issued to the respondents to pass orders on the petitioner's representation, after taking note of the above facts, within a period of six weeks, after giving notice to both the petitioner as well as the fifth respondent.

7. With the above direction, the writ petition is disposed of. No costs.
