ORDER

This writ petition has been filed seeking to quash the impugned order passed by the second respondent dated 10.03.2026 in his proceedings in Na.Ka.No. 43/2026 and consequently to direct the second respondent to register the petitioner’s document dated 29.01.2026 within a stipulated time as prescribed by this Court.

2. Heard the learned counsel appearing on either side.

3. A refusal check slip has been issued, which is under challenge, directing the parties to approach the Civil Court, to seek appropriate remedies and thereafter, re-present the document. Earlier, on an objection filed by the third respondent herein, an order was made by the District Registrar holding that the document was a fraudulent document and directing the parties to approach the Civil Court for resolving their claim with regard to the title over the property. The said proceedings came to be challenged before this Court in W.P.(MD).No.4631 of 2022, wherein, by order dated 09.08.2024, this Court set aside the finding with regard to the declaration that the document was a fraudulent one, without disturbing the direction given by the first respondent to resolve the dispute before the Civil Court. Thereafter, the petitioner again presented a document for settlement and the same was refused to be registered, pointing out the objection raised by the third respondent herein. This Court, __________

WP(MD) No. 11350 of 2026 while setting aside the order, directed the second respondent to conduct an enquiry and thereafter proceed further. Pursuant to the said direction, an enquiry was conducted, in which the third respondent did not appear. However, considering the facts of the case, the second respondent passed an order refusing to register the document and again advised the parties to approach the Civil Court for perfecting their title. Even as early as in the year 2021, when the parties were directed to approach the Civil Court for redressal of their grievances, neither the petitioner nor the third respondent had initiated any civil proceedings for resolving their dispute.

4. In that regard, this Court does not find any infirmity in the order that has been passed by the second respondent directing the petitioner to approach the Civil Court for resolving the dispute.

5. In such view of the case, I do not find any merit in this writ petition and accordingly, the same stands dismissed. The document presented by the petitioner shall be returned back to the petitioner. No costs. 08-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No TSG __________
