PRAYER: (Water body) Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a WRIT OF
MANDAMUS directing the respondents 1 to 6 to remove the encroachments made by the 7th respondent at the Sy.No.417/2 (Water Body), Sy.No.417/3 (Cart-Track) and Sy.No.417/4 (Mayanam) at Alangulam Village, Alangulam Taluk, Tenkasi District in accordance with law by considering the petitioners representation dated 20.08.2026
within a stipulated period as framed by this Honble court and pass such other or further orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER
(Order of the Court was made by G.R.Swaminathan J.) Heard the learned counsel for the petitioner and the learned Special Government Pleader for R1 to R6. Issuance of notice to R7 is dispensed with.

2. The petitioner is a resident of Alangulam. He alleges that there are encroachments in the petition mentioned survey numbers. S.No.417/2 has been classified as “water body” and it vests with the sixth respondent. S.No.417/3 has been classified as “cart track”. S.No.417/4 has been classified as “cremation ground”.
3. We direct the fourth respondent Tahsildar to conduct survey. He shall issue notices to all the interested persons before conducting survey. If the survey results indicate that there are encroachments, then Form I notice shall be issued to the sixth respondent in respect of the water body. The sixth respondent is obliged to take action under Tamil Nadu Protection of Tanks and Eviction of Encroachment Act, 2007. The fourth respondent himself can take action to clear the encroachments in the other two survey numbers. The entire exercise shall be completed within a period of five months from the date of receipt of a copy of this order. The Writ Petition is disposed of accordingly. No costs. (G.R.S.,J.)
