PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records of the impugned Order passed by the 1st respondent dated 06.03.2026 bearing Na.Ka.No.7538/2025/Sa.Pa and quash the same and direct the respondents to refix the pay scale of the petitioner with all consequential and attended benefits.

ORDER
The petitioner an employee of the co-operative store, Tiruchirappalli was placed under suspension and dismissed from service in the year 1997. The petitioner raised an industrial dispute before the Labour Court, Tiruchirappalli and the same was allowed on 23.12.2010. The petitioner with a grievance that his pay was not fixed properly when he was allowed to join duty, pursuant to the orders of the Labour Court has filed a revision petition before the 2nd respondent under Section 90 of the Tamil Nadu Co-Operative Societies on 11.10.2025 and the same was rejected by the order dated 03.11.2025. The petitioner has preferred a revision petition under Section 153 of the Tamil Nadu Co-operative Societies Act before the Joint Registrar on 27.11.2025. However, the same was rejected by the Joint Registrar by his proceedings dated in Na.Ka.No.7538/2025/Su.Ba dated 06.03.2026 that the petition has been filed beyond the period of limitation. Aggrieved by the same, the petitioner has filed this writ petition.
2. The learned counsel for the petitioner by referring to the order dated 03.11.2025 passed by the Deputy Registrar submits that this order dated 03.11.2025 was served to the petitioner. As against the same, he filed a revision petition within time on 27.11.2025. The petitioner has
WP(MD) No. 29096 of 2026 also enclosed the E-challan issued by the department for receipt of fee Rs.1,000/- for the revision filed under Section 153 of the Tamil Nadu Co-Operative Societies Act.
3. Heard the learned counsel on either side.
4. Considering the E-challan dated 27.11.2025, this court is inclined to allow this writ petition. Accordingly, this writ petition is allowed with a direction to the 1st respondent / Joint Registrar to entertain the revision petition filed by the petitioner and dispose of the same on merits within a period of three months from the date of receipt of a copy of this order. No costs. Consequently connected miscellaneous petition is closed. 08-10-2026 DSK
