PRAYER:
Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to consider the petitioners representation dated 08.08.2026 and consequently conduct survey, measure and demarcate the petitioners property comprised in Survey No.129/2 situated at Naganoor Village, Kuzhithalai Taluk, Karur District, after issuing notice to all necessary parties and pass appropriate orders within a time frame fixed by this Honble Court and consequently provide necessary police protection, if warranted, during survey proceedings.

ORDER
Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for Respondents 1 and 2 and the learned Counsel for State of Tamil Nadu (Criminal Side) appearing for the 3rd respondent.
2. This Writ Petition is filed for issuance of Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 08.08.2026 and consequently conduct survey, measure and demarcate the petitioners property comprised in Survey No.129/2 situated at Naganoor Village, Kuzhithalai Taluk, Karur District, after issuing notice to all necessary parties and pass appropriate orders and consequently provide necessary police protection, if warranted, during survey proceedings.
3. Considering the limited relief that has been sought for in the Writ Petition, notice to the 4th respondent is dispensed with.
4. It is the claim of the petitioner that he had submitted an application and paid the necessary charges for surveying the lands as early as on 10.09.2020. However, the same has not been considered. Hence, the petitioner made a representation dated 08.08.2026 in that regard. __________

Considering the fact that the petitioner has made a representation dated 08.08.2026, which is supported by the challan evidencing payment made on 10.09.2020, there shall be a direction to the 2nd respondent to consider the petitioner's representation dated 08.08.2026, along with the challan placed before this Court, and pass orders on its own merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order, in consonance with the provisions of Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, after providing an opportunity of hearing to the petitioner, 4th respondent and interested persons, if any. If the 2nd respondent requires the assistance of the 3rd respondent, it is open to him to seek such assistance at the cost of the petitioner.
6. It is made clear that the order passed and the proceedings undertaken pursuant thereto would not confer any right to possession of the property if the same is in the hands of third parties.
