PRAYER:
Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, forbearing the 5th Respondent from registering any sale deed dated 20.09.2026 with regard to the Petitioner's property bearing Survey No.805, measuring an extent of 3.80.5 hectares equivalent to 9 Acres 40 Cents, situated at Inam Surangudi Village, Sattur Taluk, Virudhunagar District by considering Petitioner's representation/ Objection Petition dated 30.09.2026 and 03.10.2026.

ORDER
Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for Respondents 1, 3 and 5 and the learned Counsel for State of Tamil Nadu (Criminal Side) for Respondents 2 and 4. Since no adverse order is going to be passed against the respondents 6 and 7, notice to them is dispensed with.

The petitioner has approached this Court seeking a Writ of Mandamus restraining the 5th Respondent from releasing the document presented for registration on 20.09.2026, primarily on the ground that the sale consideration payable to the petitioner has not been paid by Respondents 6 and 7. Having presented the document for registration, the petitioner, who is the vendor under the document, submitted a complaint
WP(MD) No. 29132 of 2026 dated 30.09.2026 alleging that the private respondents, who are the purchasers, had not paid the entire sale consideration in respect of the property in question. For recovery of the unpaid sale consideration, it is open to the petitioner to approach the competent Civil Court by instituting a suit for recovery of the amount due. The petitioner cannot, however, seek to restrain the registering authority from discharging its statutory duties under the Registration Act. Further, the 5th Respondent is not vested with the power to adjudicate disputes relating to the non-payment of sale consideration.

In view of the above observations, this Writ Petition is dismissed, with liberty to the petitioner to approach the competent Civil Court for appropriate relief in respect of the grievance raised in the complaint.
