ORDER

The present Writ Petition has been filed in the nature of a Certiorari challenging the impugned order passed by the third respondent, dated 07.02.2012 and the consequential order passed by the second respondent, dated 12.04.2017.

2. Heard Mr.S.Rajasekar, learned Counsel for the petitioner and Mr.M.Dinesh Hari Sudarsan, learned Additional Government Pleader for the respondents 1 to 4.

3. It is the case of the petitioner that she is the absolute owner and in possession and enjoyment of the subject property. Since there is a rival dispute with regard the title over the subject property between the petitioner and the fifth respondent, the patta issued in favour of the petitioner was cancelled at the instance of the fifth respondent, by the third respondent. Against which, the petitioner has filed a revision before the second respondent, which also came to be dismissed vide impugned order. Challenging the same, the present Writ Petition has been filed. __________

4. The issue on hand had already been dealt with by the Hon’ble Division Bench of this Court in the case of Kuppuswami Nainar -vs.- The District Revenue Officer and others, reported in (1995) 1 MLJ 426, wherein, the Hon’ble Division Bench has categorically held that the issue with regard to the title and issuance of the patta could not be dealt with by this Court under Article 226 of the Constitution of India and such dispute can only resolved by the competent civil Court.

5. Hence, the Writ Petition is disposed of with liberty to the petitioner to approach the competent civil Court. However, it is made clear that during the pendency of the civil proceedings, no further proceedings in respect of the mutation of revenue records with regard to the subject property shall be undertaken by the revenue authorities. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 08-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No cmr __________
