COMMON JUDGMENT

The above appeals have been filed by the defacto complainant challenging the order of bail granted to A1, A4 and A5, who are accused of offences under Sections 3(1)(g) and 3(1)(u) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.

CRL A Nos.203 and 216 of 2022

2. The allegation against the third respondent/A1 in Crl.A.No.203 of 2022 and the third and fourth respondents/A4 and A5 in Crl.A.No.216 of 2022 and the other accused is that they had abused the de-facto complainant, the appellant herein, in filthy language on account of an earlier property dispute and thus committed the aforesaid offences.

3. By the impugned order, the learned Principal Sessions Judge, Dharmapuri District, had granted bail in Crl.M.P.Nos.1474 of 2021 and 1555 of 2021 dated 15.09.2021 and 27.09.2021, respectively, after considering the nature of the case and after noting the order passed by this Court in Crl.O.P.No.14456 of 2021 dated 18.08.2021 and Crl.O.P.No.16414 of 2021 dated 14.09.2021, wherein this Court had directed the learned Judge to consider the bail on the same day on merits.

4. Heard the learned counsel for the appellant in both the appeals, who would submit that the Trial Court ought not to have granted bail.

5. It is five years since the order of bail was granted by the learned Principal Sessions Judge. The learned Additional Public Prosecutor

CRL A Nos.203 and 216 of 2022

would state that the trial is pending. This Court finds no infirmity whatsoever in the order granting bail to the private respondent in the appeal. Admittedly, the other accused had also been granted bail by the learned Sessions Judge. Hence, these Criminal Appeals are dismissed. 07-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No dk To
