ORDER

This Civil Revision Petition has been filed seeking a direction to the Trial Court to dispose of the final decree application in I.A.No.20 of 2026 in O.S.No.10 of 2014, within a time frame as fixed by this court.

2. The petitioner herein filed a suit in O.S.No.10 of 2014 seeking partition. In the said suit, preliminary decree for partition was passed on 06.10.2025, allotting 14/48 shares in favour of the petitioner in respect of Item Nos.1 to 3 and 5 to 7 of the suit properties. Based on the said preliminary decree, the petitioner filed an application in I.A.No.20 of 2026 seeking to pass final decree. In the said final decree application, the Trial Court has ordered notice to the respondents and the some of the respondents are not yet served. Hence, the petitioner has come before this court seeking expeditious disposal of the said final decree application.

CRP No. 6463 of 2026

3. It is seen from the typed set of papers that though the respondents 1 to 4 in the final decree application were not served, fresh notice has been ordered to them on 19.08.2026, returnable by 09.10.2026. Since service of notice on all the respondents are not yet completed, this court is not inclined to go give any direction to the Trial Court to dispose of the final decree application, within a time frame. However, taking into consideration that the suit is of the year 2014, the Trial Court is directed to dispose of the final decree application in I.A.No.20 of 2026 as expeditiously as possible.

4. With the above direction, this civil revision petition is disposed of. There shall be no order as to costs. 07-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No MST To The I Additional District and Sessions Judge, Tiruppur.
