ORDER

The present writ petition has been filed seeking a Writ of Mandamus directing the first and second respondents to provide the petitioner with permanent alternative employment, with continuity of service, pay protection and other consequential benefits until his superannuation, based on the latest medical report of the petitioner, within a time frame to be fixed by this Court.

2. The learned counsel for the petitioner would submit that the petitioner joined the respondent Corporation as a Driver in the year 2008 and has been serving as a Driver since then. In the meanwhile, he suffered a setback in his health and was diagnosed with a spinal cord issue. In this regard, he was assessed by the Medical Board, which recommended that he was unfit to work as a Driver. Pursuant to the said recommendation, the petitioner was provided with light duty.

3. However, the grievance of the petitioner is that light duty has not been

WP No. 18672 of 2022

continuously provided to him. The respondents have provided light duty only for a short period, namely, 15 days in a month, and thereafter, no work was provided to him for the next two months, resulting in loss of pay. Hence, the petitioner has come up with the present writ petition seeking a direction to provide him with permanent alternative employment with continuity of service, pay protection and all other incidental benefits until his superannuation.

4. Per contra, the learned Standing Counsel appearing for the respondents, though would object to the contentions of the learned counsel for the petitioner, would, in all fairness, submit that the petitioner has been suffering from certain ailments and, based on the report of the Medical Board, he has been provided with light duty.

5. The learned Standing Counsel appearing for the respondents would further submit that the petitioner would be provided with light duty continuously, subject to the opinion of the Medical Board. He would also submit that the petitioner is required to appear before the Medical Board once in every six months.

6. In this regard, the learned counsel for the petitioner undertakes that the petitioner would appear before the Medical Board once in every six months. However, until the next report of the Medical Board is received, the respondents

WP No. 18672 of 2022

shall not deny alternative duty to the petitioner.

7. In view of the fair submission made by the learned Standing Counsel appearing for the respondents, this Court directs the first and second respondents to provide the petitioner with permanent alternative employment with continuity of service, pay protection and other incidental benefits, subject to the opinion of the Medical Board from time to time.

8. Accordingly, this writ petition is allowed in the above terms. No costs. The connected miscellaneous petition is closed. 07-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No JRS
