ORDER

This Writ Petition has been filed for the following reliefs:- “Directing the first respondent to provide electricity service connection to the petitioners K.T.K Madhu Hospital bearing No.704, T.H Road, old washermentpet, chennai – 600021.”

Brief Facts:-

2. Originally, the 3rd respondent Trust had entered into a lease agreement with the 2nd respondent in respect of the subject property, who, in turn, sub-let the same to the petitioner. The petitioner has undertaken to run a hospital in the subject property belonging to the 3rd respondent Trust. The 2nd respondent was a lessee under the 3rd respondent Trust and had executed a Caretaker Agreement in favour of the petitioner, authorising the petitioner to run the hospital in the name and style of “MTK Madhu Hospital.”

3. Thereafter, the petitioner submitted an application seeking an electricity service connection in the name of the 2nd respondent. However, the said application was not considered by the 1st respondent on the ground that the 3rd respondent Trust had raised an objection and that no lease was subsisting in favour of the 2nd respondent.

WP No. 39125 of 2026

4. Seeking the basic amenity of electricity connection for running the hospital in the subject premises, the petitioner has approached this Court by filing the present Writ Petition.

5. Heard the learned counsel on either side and perused the records.

6. When the matter was taken up for hearing, the learned counsel appearing for the 1st respondent brought to the notice of this Court the objection letter submitted by the 3rd respondent Trust, dated 10.08.2026. A perusal of the said objection letter would show that, initially, in respect of the subject property, the 3rd respondent Trust had entered into a lease agreement with the 2nd respondent for running a hospital in the name and style of “Madhu”. Thereafter, the 2nd respondent had sub-let the subject premises to the petitioner herein under an agreement styled as a “Caretaker Agreement”, dated 02.07.2026. In the said objection letter, it is further stated that the lease agreement had not been renewed and that the hospital was not being run in the subject premises. The 3rd respondent Trust had also stated that the original lease agreement was executed in the year 2006 for a period of 11 months. The 3rd respondent Trust has further stated that the subject property has remained closed for more than six years.

WP No. 39125 of 2026

7. The learned counsel for the 1st respondent has submitted that, on account of arrears of electricity charges, the Electricity Board had disconnected the electricity service connection in the year 2023, even prior to the execution of the Caretaker Agreement entered into between the petitioner and the 2nd respondent. It is also brought to the notice of this Court that the petitioner had illegally reconnected the electricity service connection, which was subsequently disconnected.

8. Therefore, in view of the serious objections raised by the original owner of the subject property, namely the 3rd respondent Trust and having regard to the conduct of the petitioner, this Court is of the view that the relief sought for by the petitioner cannot be granted.

9. Accordingly, the Writ Petition stands dismissed. It is needless to state that, if the original owner of the subject property makes an application for restoration of the electricity service connection after clearing the arrears, the same shall be considered by the 1st respondent Electricity Board in accordance with law. No costs. Consequently, the connected Miscellaneous Petition is closed. 07-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SHR
