ORDER

Heard Mrs.Gladys Daniel, learned counsel for the petitioner and Dr.K.Kannan, learned Senior Panel Counsel for Central Government, for the respondent.

2. The limited grievance of the petitioner is that the Petitioner's Application for being recorded as the Registered Proprietor for the Trademark "Amamma", has been pending right from 2023. Mrs.Gladys Daniel, learned counsel for the petitioner took me through the averments in the affidavit in support of the Writ Petition and states that there is absolutely no progress in the matter and despite there being no objection from any third party, much less the parties who had assigned to mark in favour of the petitioner, or the predecessor who has originally assigned the mark in favour of one Mr.D.Venkata Krishnan. According to her, the respondent ought to have proceeded to recognize the right of the petitioner and pass final orders.

3. Per contra, Dr.K.Kannan, learned Senior Panel Counsel appearing for the respondent would bring to my notice that as stated that the respondent has issued a notice on 07.08.2026 to the original proprietor, Mr.D.Venkata Krishnan, about the request of the writ petitioner and that they have not heard

WP(IPD) No. 24 of 2026

from the said Venkata Krishanan, thereafter. The learned counsel also invites my attention to the averments in the counter affidavit dated 30.09.2026, where the respondent states that since 30 days has lapsed since service of notice on Venkata Krishnan, the respondent will examine the request of the petitioner and pass orders on the basis of available records.

4. I do not see any impediment for the respondent taking up the request of the petitioner and passing final orders. Considering that the notice has already been served under the Trademark Rules, 2017, the respondent having rightly addressed the communication to the original registered proprietor, and even as admitted by them, the 30 days period has already lapsed, therefore, the petitioner's application needs to be processed without any further delay.

5. In the light of the above, the Writ Petition is allowed, with a direction to the respondent to pass final orders on the petitioner's application to be recognized as a registered proprietor of the Trademark Amamma, within a period of four (4) weeks from the date of receipt of the copy of the order. No costs. 07-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No RKP
