ORDER

The petitioner, working as an Office Assistant in the respondent Society, was issued with a show cause notice dated 27.09.2024 by the 3rd respondent. Challenging the same, the present writ petition has been filed.

2. This Court, while entertaining this writ petition, has granted an order of status quo, by order dated 17.07.2025. The respondent Society has filed a petition in WMP(MD)No.17135 of 2026 seeking to vacate the interim order granted by this Court. Therefore, this writ petition is taken up for final disposal on consent.

3. The contention of the petitioner is that the 3rd respondent/the Administrator, taking charge of the Management in the place of Elected

WP(MD) No. 19298 of 2025 Board, has no locus to issue this show cause notice, when he has been appointed by the Board. In the event, if the Board wants to review its own order, it can be made only by the 1st respondent/the Joint Registrar of Co-operative Societies and the Administrator is not having any locus.

4. The learned Additional Government Pleader submits that the petitioner has been appointed by the Board without following the Tamil Nadu Co-operative Societies Rules, particularly, Rule 149(2) of the Tamil Nadu Cooperative Societies Rules and Special bye-law 7-A of the Society. Therefore, a show cause notice has been issued by the Administrator. According to the learned Additional Government Pleader, the petitioner has been appointed in a fraudulent manner, recording as if he has been forwarded by the Employment Exchange, however, it is not so. He further submits that this is an internal affair of the Co-operative Society. As per the dictum laid down by the Hon’ble Full Bench in K.Marappan vs. The Deputy Registrar of Co-Operative Societies, reported in 2006 (4) CTC 689, this writ petition cannot be maintained.

5. This Court considered the rival submissions made.

WP(MD) No. 19298 of 2025

6. The order impugned in this writ petition is only a show cause notice and that too issued by the Administrator of the Cooperative Society. As rightly pointed out by the learned Additional Government Pleader, this Court is not supposed to entertain this writ petition, as per the dictum laid down in Marappan’s case as cited above. Moreover, serious allegations have been made as against petitioner as to the manner in which he has been appointed. Therefore, this Court is not inclined to entertain this writ petition.

7. Accordingly, this writ petition is dismissed, with liberty to the petitioner to approach the first respondent, if he is aggrieved. No costs. Consequently, connected miscellaneous petitions are closed. 07-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ogy
