ORDER

The petitioner a retired Headmaster has approached this court seeking a writ of mandamus directing the respondents to disburse the retirement benefits to the petitioner. The petitioner was allowed to retire on attaining the age of superannuation on 31.05.2025. However, the retirement benefits eligible to this petitioner have not been disbursed and therefore, this petitioner is before this court.

2. The learned counsel for the petitioner submits that the petitioner was allowed to retire from service 31.05.2025. However the eligible retirement benefits due to this petitioner were not settled in view of the registration of a criminal case in Crime No.4 of 2025 on the file of the All Women Police Station, Thoothukudi. This criminal case, according to the learned counsel, was registered as against one Teacher on the allegation of abusing students. In the said criminal case the petitioner is added as an accused that this petitioner was informed about the incident by another Teacher, however, this petitioner failed to take necessary action by lodging a complaint. He is facing the trial in SplC.No.96 of 2025 before the Special Court for Exclusive Trial of Cases under

WP(MD) No. 26567 of 2025 POCSO Act, Thoothukudi. The petitioner has filed an application to quash the proceedings, however, the same was dismissed by this court with liberty to the petitioner to workout his remedy before the trial court.

3. He further submits that there is no charge as against this petitioner. The 3rd respondent management has issued a memo to the petitioner and after his explanation, they have not initiated any disciplinary proceedings as against the petitioner. The 3rd respondent has already informed the 2nd respondent on 28.05.2025 that there is no possibility of initiating disciplinary proceedings as against the petitioner. However, the 3rd respondent has not sent any proposal for disbursement of the retirement benefits and therefore, the petitioner is before this court.

4. The learned counsel appearing for the 3rd respondent submits that the petitioner has not signed the necessary documents and therefore, they could not send the proposal. In the event, the petitioner signs in the necessary documents, they would forward the proposal to the 2nd respondent.

5. In view of this submission of the 3rd respondent that they are not inclined to initiate disciplinary proceedings as against the petitioner and they would forward the necessary proposal as and when the petitioner signs the

WP(MD) No. 26567 of 2025 necessary documents, this writ petition is disposed of with liberty to the petitioner to sign the necessary documents and thereafter, the 3rd respondent shall take necessary action in accordance with law.
