PRAYER: S-19. Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, to direct the respondents to conclude the disciplinary proceedings initiated as against the petitioner in pursuant to the charge memo dated 05.03.2026 issued by the 3rd Respondent vide proceedings in Na.Ka.No.6670/Nirvaham/2025-l and the 2nd charge memo dated 05.03.2026 issued by the 3rd Respondent vide proceedings in Na.Ka.No.6670/Nirvaham/2025-2, strictly in accordance with the Rule 11 of Conduct, Discipline and Appeal Rules in The Union Bye Laws and consequently to direct the respondents to accord permission to the petitioner to resign from his post within the stipulated time fixed by this Honble Court.

O R D E R
The petitioner, who was working as a Deputy Manager of Villupuram Co-operative Milk Producers Union Ltd., is facing disciplinary proceedings. Charge memos were issued by the Managing Director of the Thanjavur District Co-operative Milk Producers Union Ltd., Thanjavur /the third respondent herein, on 05.03.2026. The petitioner, with a grievance that the disciplinary proceedings is pending for the past seven months without any progress. has filed this writ petition, seeking a Mandamus, directing the respondents to conclude the disciplinary proceedings as expeditiously as possible.
2. The learned counsel appearing for the petitioner submits that the petitioner has sought for certain documents to defend his case, however, the same has not been provided to him till date.
3. Mr.L.Siva, learned Government Advocate takes notice for the respondents 1 & 2. Mr.M.Thirunavukkarasu, learned Standing Counsel takes notice for the third respondent and submits that the petitioner was issued with a charge memo on certain irregularities. He further submits that some documents have been furnished to this partitioner and he was directed to peruse some other documents at any point of time. Without doing so, the petitioner has approached this Court. Moreover, he has not offered any explanation to the charge memo and therefore, the disciplinary proceedings has not been proceeded further.
4. This Court considered the rival submissions made and also perused the materials placed on record.

The petitioner claims that the charge memo issued as against him in the month of March 2026, is pending without any progress and the documents, which have been sought for by the petitioner were not provided to him. The learned Standing counsel for the third respondent submits that some of the documents have already been provided to this petitioner and for the remaining documents, he was directed to peruse the same. However, he has not perused the documents and delaying the process by not furnishing his explanation to the charge memos.

In view of the rival submissions made, this writ petition is disposed of, with a direction to the petitioner to appear before the respondent on 13.10.2026 at about 10:30 a.m. The respondent shall furnish the relevant documents and shall permit the petitioner to peruse the remaining documents. The petitioner is expected to offer his explanation on or before 16.10.2026. Thereafter, the respondents are expected to conclude the disciplinary proceedings, by appointing an enquiry officer as prescribed in Rule 11 of the Byelaw of the third respondent Society, within a period of three months from thereon.
