ORDER
The present writ petition has been filed challenging the impugned refusal check slip dated 24.08.2026 issued by the second respondent and consequently seeking a direction to the second respondent to register the gift deed presented by the petitioner.
2. The refusal check slip has been challenged, wherein the registration of any document has been objected to by the second wife of the person in whose name the property stands. It is not a reason contemplated under the statutory provisions of the Registration Act for refusal to register any document.
3. The learned counsel for the petitioner would contend that when an objection is made by a third party with respect to a property, claiming herself to be the second wife registration of a document by another person, who is the first wife of the deceased, would only create further disputes between the parties. In that regard, the registering authority cannot be permitted to decide the title between the parties.
4. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing on behalf of the respondents 1 and 2.
WP(MD) No. 29025 of 2026
5. Admittedly, in the present case, the refusal does not indicate any order of the Court favouring the second wife in respect of the property covered by the document sought to be registered. Further, if an objection is raised for registration of a document, it should necessarily be supported by an order passed by a competent Court.
5. Fore the aforesaid reasons, the impugned check slip stands set aside with a direction to the second respondent to receive the document presented by the petitioner. It is open to the third and fourth respondents to approach the competent Civil Court to remedy their grievances.
6. The writ petition stands allowed. No costs. 07-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No PKN
