to call for the records relating the proceedings of the Impugned Order in Pa.Ka.No 2008 dated 08.09.08 on the file of the 5th Respondent and the Impugned Order in O.Mu.No. - 3492/Aa/5/2024 dated 27.12.2024 on the file of the 3rd Respondent and the Impugned Order in Na.Ka.No.1716/Aa2/2024 dated 13.01.25 on the file of the 4th Respondent and the consequent Impugned Communication dated 29.01.25 on the file of the 5th Respondent and quash the same and further direct the Respondents to disburse the retirement benefits within a time stipulated by this Honble Court and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

O R D E R
The petitioner, a Secondary Grade Teacher of Savundeeswari Middle School, Theni /the fifth respondent was dismissed from service on 08.09.2008. After 16 years, this petitioner has submitted a representation to the respondents, seeking his terminal benefits, and the same has been rejected by the third respondent, by order dated, 27.12.2024. The said order of rejection has been communicated to this petitioner on 13.01.2025, which is under challenge in this writ petition.
2. This Court is not inclined to entertain this writ petition on the ground of laches. However, in order to ascertain if any eligible amount is due to this petitioner, notice is ordered to the fifth respondent School. Despite service, the fifth respondent has not preferred to appear before this Court.
3. The petitioner, who was working as a Secondary Grade Teacher is said to have abandoned the fifth respondent School during March 2000. Thereafter, he was removed from service on 08.09.2008. The order of removal from service has been challenged by way of this writ petition only in the year 2025, and therefore this Court is not inclined to entertain this petition, on the ground of laches.

However, in the interest of justice, the fifth respondent is directed to find out as to whether any amount, such as Aided School Teachers Fund, Special Provident Fund and Earned Leave Salary is due to this petitioner and in such case, shall make necessary proposal to the District Elementary Education Officer, Theni/the third respondent, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of receipt of any such proposal, the third respondent shall pass necessary orders within a period of eight weeks from thereon.
5. With the above observations and directions, this writ petition is disposed of. No costs. Consequently, connected Miscellaneous petition is closed. 07-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No vrn
