PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the respondents 1st and 2nd respondents to remove the encroachments made by the 3 to 5
respondents in the Survey No.245/1 situated in the Maravanmadam, Nallamalai Village, Pudukottai, Thoothukudi District based on the petitioners representation dated 09.09.2025 within a time stipulated by this Honble Court and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER
(Order of the Court was made by G.R.Swaminathan J.) Heard both sides.
2. The petitioner alleges that the respondents 3 to 5 have committed encroachments. The private respondents herein moved the jurisdictional civil Court. R4 & R5 succeeded and obtained the decree of declaration in their favour. However, R3 lost. R3 has filed O.S.No.155 of 2023 on the file of the Sub Court, Thoothukudi.

3. While this writ petition has become infructuous as regards R4 & R5, liberty is given to the writ petitioner to move afresh against R3 after the appeal filed by the third respondent is disposed of.
