PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, directing the 4th respondent to take effective steps to remove the encroachment made in survey Nos.46, 48/1, 48/2 situated at Neeraethan Village, Vadipatti Taluk, Madurai District based on the communication issued by the 3rd respondent in O.MU.E.No.3883754/2025/I
dated 25.10.2025 and to pass such further relives as this Hon'ble Court may deem fit and proper in the circumstances of this case and thus render justice.

ORDER
(Order of the Court was made by G.R.Swaminathan J.) Heard both sides.
2. The writ petitioner is a resident of Neeraethan Village. He alleges that there are encroachments in the petition mentioned survey numbers. He wants the same to be removed.

3. The learned Special Government Pleader states that S.No.46 has been classified as “Vandi Pathai”, while S.No.48/1 & S.No.48/2 have been classified as “Salai”. No encroachment can be allowed in any of the aforementioned three survey numbers. It is stated that a public toilet has been put up by expending public funds in one of the survey numbers. It can very well remain. All other encroachments shall be removed. The petitioner is ready to have the digital survey conducted at his expense.
4. The petitioner is permitted to submit a formal application to the fourth respondent. The digital survey shall be held after issuing notice to the interested parties. Based on the results of the digital survey, encroachment shall be identified and except public toilet as mentioned above, all other constructions will be cleared. Entire exercise shall be completed within a period of five months from the date of receipt of a copy of this order. As and when the services of the impleaded respondent is required, the Inspector of Police, Vadipatti Police Station, Madurai shall extend his fullest assistance to facilitate complete removal of the encroachment.
